Weather Policy for Bruschi Boat Rental LLC, Altamar Trade LLC, and Affiliates

General Policy

Customers must show up for their reservation to be eligible for the policy, unless they have written consent from the company stating otherwise. Customers who do not show up will be marked as a no-show and will not receive a refund, even if they opted for weather protection.

Late Arrivals will not be considered for this policy. If a customer arrives late, the policy becomes a rain or shine policy, meaning the trip will proceed regardless of weather conditions, except for:

  • Bulletins created by the USCG (United States Coast Guard) limiting boats to operate in the area of the charter. The bulletin must specifically include the bay or body of water where the charter is located. Bulletins for the coast or open water will not apply to this policy.
  • The company do not go by the weather forecast, nor will accept weather forecast screenshots since the veracity of these weather apps is not accurate.

Cold weather is not grounds to cancel a reservation or reschedule.

The weather must be a thunderstorm happening at the moment of the rental. Weather in Miami changes frequently and very quickly, so forecasts are not sufficient to determine cancellations.


Cancellations

Cancellations due to weather must be called by the captain only. If the captain deems the weather safe for navigation, the charter will proceed. If the customer refuses to participate, their reservation will be marked as a no-show without the right to a refund.


Weather Policy Before Departure

  • If weather does not permit the rental to proceed after 20 minutes from the scheduled start time:
    If the charter starts within the 20 minutes, the charter time will be considered when the captain states is ready for departure, we do recommend filling out the forms needed for departure during the waiting time so you don’t waste time from your charter.

Customers with Weather Protection:

  • Will receive a full refund, minus the weather protection amount.

Customers without Weather Protection:

  • Will have two options:
    a) Reschedule to another available time, or
    b) Receive a refund minus 20% of the total amount or $40, whichever is higher, for operational expenses.

Cancellation Procedure After a Weather-Related Cancellation (Without Weather Protection)

  1. Customers must send an email to info@bruschiboatrental.com stating their intention to reschedule or receive a partial refund.
  2. Refunds will be processed within 1 business day as outlined above.
  3. If rescheduling, customers will receive a gift card for the full rental amount, valid for future use.
  4. An email from the customer confirming their intention is required.

Cancellation Procedure With Weather Protection

  1. Customers must send an email to info@bruschiboatrental.com confirming that the rental did not proceed due to weather.
  2. Customers will receive a full refund, minus the weather protection amount.
  3. Refunds will be processed within 1 business day.

Groupon Customers

Groupon customers have two options:

  • With Weather Protection: Groupon will handle the refund procedure for the voucher.
  • Without Weather Protection: Customers may reschedule to another available time.

Additional Conditions:

  • No further reschedules or cancellations will be allowed after a rescheduled reservation.
  • Customers are not required to have a new date immediately. They can cancel the reservation and call to make a new reservation within 4 months of the original cancellation.
  • After 4 months have passed the customer will loose the right to a reschedule. 

After Departure on the Boat

  • There will be a 20-minute grace period (verified via GPS tracker) to return to the marina if weather conditions worsen.

All Customers (Regardless of Weather Protection):

  • Option a) Opt for a 70% refund, or
  • Option b) Reschedule to another available time.

Groupon Customers:

  • May only reschedule to another available time after departure.

Captain Payment Requirement:

  • The captain must be paid for 1 hour of service. If the customer refuses, the rental amount will be forfeited in full.

Weather Protection

Weather Protection shields customers from the risk of rentals being hindered by adverse weather conditions. This coverage entitles customers to a full refund, provided the weather policy procedures are strictly followed (see above).

Please note:

  • Weather protection does not exempt customers from showing up for their reservation.
  • The cost of weather protection itself will not be included in the refund.

No Assumptions

Do not assume your reservation is canceled due to weather conditions unless you receive written confirmation from the company regarding severe weather.

Failure to show up for your scheduled time without written confirmation of cancellation will result in being marked as a no-show.
